1. Data Collection & Eligibility

The Service is intended for users at least 17 years of age. Minor Users (age 17) require verifiable parental consent. We do not knowingly collect data from individuals under 17.

Information We Collect

• Identifiers: Name, date of birth, mobile phone number, IP Address, and device IDs. We do not collect email addresses for account registration.
• Sensitive Data: Race, religion, sexual orientation, and gender expression to improve matching and community safety.
• User Content: Photos, videos, and biographies. Camera/gallery access is requested for uploads.
• Biometric Data: Face verification templates used solely for identity confirmation and fraud prevention.
• Event & Marketplace Data: Records of events created or tickets purchased/sold, including venue, date, and attendee lists.
• Payment Information: Credit card or billing data processed by PCI-DSS compliant third parties. Visible does not store full credit card numbers.
• Payout Information (Plug Program): For users participating in the Plug Program, we collect payout information necessary to process commission payments, including bank account details (routing and account numbers), payment processor account credentials (e.g., Stripe Connect or PayPal account information), and payout preferences. This information is collected directly from you and processed through our PCI-DSS compliant payment partners.
• Tax Information (Plug Program): For Plugs who earn commissions at or above the applicable tax reporting threshold (currently $600 USD per calendar year for U.S.-based Plugs), we may collect tax identification information, including Social Security Numbers (SSN), Employer Identification Numbers (EIN), or Individual Taxpayer Identification Numbers (ITIN), as well as completed IRS W-9 forms (or W-8BEN forms for non-U.S. persons). This information is collected solely for the purpose of tax reporting compliance and issuing required tax documents (e.g., IRS Form 1099-NEC).

2. Data Usage & Commercial Terms

We process your information to provide the Service, ensure security, and comply with law.

2.1 Technical Processing & Watermarking

Visible applies branded watermarks or digital identifiers to User Content prior to public distribution on Instagram or other community channels. This identifies Visible as the source and deters unauthorized third-party scraping.

2.2 Commercial Use & Likeness (18+)

For users 18 and older, you grant Visible a royalty-free license to use your User Content, name, and likeness in paid advertisements and brand promotions without further compensation to you. Minor Users are strictly excluded from commercial advertising pools.

2.3 Marketplace Role

Visible acts as a facilitator for ticketing. Users 18+ may sell tickets; Minor Users (17) may purchase only. Visible is not the event organizer. All transactions, subscriptions, and ticket sales are final and non-refundable.

Visible does not verify, authorize, or guarantee any relationship between event organizers and the venues referenced in their event listings. Venue names, addresses, and other location data included in event listings are provided solely by the event organizer and do not imply endorsement, affiliation, or authorization by the venue or by Visible Technologies LLC.

2.4 Plug Program Data Usage

For users participating in the Plug Program, we use the information collected to:

• (a) Calculate, track, and process commission payouts;
• (b) Verify the identity of Plugs and prevent fraud;
• (c) Comply with tax reporting obligations, including issuing IRS Form 1099-NEC or other required tax documents;
• (d) Monitor referral activity for compliance with our Terms of Use and Acceptable Promotion Practices;
• (e) Communicate with Plugs regarding their account, commissions, and program updates.

Payout and tax information is stored securely using industry-standard encryption and is accessible only to authorized personnel and compliant third-party payment processors.

3. Data Transfer & Disclosure

Your data may be transferred to and processed in the United States. We share data with service providers (Payments, Cloud Hosting) solely to facilitate the operation of our Service. We also share data with event creators (attendee names/identifiers) to facilitate entry. Our integration with Meta (Instagram) adheres to Meta's Developer Data Use Policy.

Phone numbers collected for SMS opt-in purposes are shared only with our SMS service provider (Twilio) for the sole purpose of delivering text messages. Mobile phone numbers and SMS opt-in data are never shared with, sold to, or disclosed to any third parties or affiliates for their own marketing or promotional purposes under any circumstances.

Plug Program Disclosures: For Plugs, payout information is shared with our designated payment processor(s) (e.g., Stripe, PayPal) solely for the purpose of processing commission payments. Tax identification information (SSN, EIN, ITIN) may be shared with tax compliance service providers and reported to the Internal Revenue Service (IRS) or other applicable tax authorities as required by law. We do not sell, rent, or share Plug payout or tax information for marketing or promotional purposes.

3.1 Disclosure in Response to Legal Requests

Visible Technologies LLC may disclose user information, including organizer account details and Content, when we believe in good faith that disclosure is necessary to: (a) comply with applicable law, regulation, or legal process; (b) respond to valid legal requests, including subpoenas, court orders, or government investigations; (c) protect the rights, property, or safety of Visible Technologies LLC, our users, or the public; or (d) enforce our Terms of Use.

When permitted by law, Visible will make reasonable efforts to notify affected users before disclosing their information in response to legal requests.

4. Regulatory Rights (GDPR & CCPA)

4.1 GDPR (EU/EEA)

Residents have rights to access, rectification, erasure (the “right to be forgotten”), restriction of processing, data portability, and the right to withdraw consent.

4.2 California Privacy Rights (CCPA/CPRA)

• Right to Know & Delete: Request disclosure of collected data and deletion thereof.
• Right to Correct: Rectify inaccurate personal information.
• Non-Discrimination: No denial of service for exercising privacy rights.
• Do Not Track: We honor Do Not Track signals.

5. Data Retention & Security

Biometric templates are destroyed within one year of inactivity. Transaction records are kept for 7 years. We use industry-standard encryption (AES/TLS) to secure data in transit and at rest.

Visible Technologies LLC retains event listing data, including historical versions and edit logs, for a minimum of two (2) years following the event date or the removal of the listing, whichever is later, for the purposes of legal compliance, dispute resolution, and enforcement of our Terms of Use.

Plug Program Data Retention: Payout records, commission histories, and referral activity logs are retained for a minimum of seven (7) years for tax compliance and audit purposes. Tax identification information (SSN, EIN, ITIN, W-9/W-8BEN forms) is retained for the period required by applicable tax law (generally seven years from the date of the relevant tax filing). Upon request, Plugs may request deletion of their payout information after the legally required retention period has expired.

6. SMS/Text Messaging Program

Visible Technologies LLC (“Visible”) operates an SMS and text messaging program to communicate with users who have provided their mobile phone number and opted in to receive text messages through the Visible website at https://visibleapp.co.

6.1 Types of Messages

Messages sent through this program include, but are not limited to: application submission confirmations, bio completion reminders, deadline notifications, account status updates, and promotional messages about Visible platform features and services.

6.2 Opt-In and Consent

By providing your mobile phone number and actively checking the SMS opt-in checkbox during account registration on our website, you expressly consent to receive recurring automated marketing and informational text messages from Visible Technologies LLC. The opt-in checkbox is not pre-selected; you must actively choose to opt in.

Consent to receive text messages is not required as a condition of using our Service, creating an account, or making any purchase.

6.3 Message Frequency and Rates

Message frequency varies depending on your account activity and applicable deadlines. Message and data rates may apply depending on your mobile carrier and plan. Visible is not responsible for any charges imposed by your carrier. Carriers are not liable for delayed or undelivered messages.

6.4 Opt-Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. You may also text STOP to our sending number at any time. Upon opting out, you will receive a single confirmation message, and no further messages will be sent unless you re-subscribe. You may also contact us at support@visibleapp.co to request removal from our messaging program.

6.6 Mobile Information Privacy

No mobile information, including mobile phone numbers and SMS opt-in data, will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Mobile opt-in consent data, including phone numbers and records of consent, will not be rented, sold, or disclosed to any third party under any circumstances. Your mobile information will be used exclusively by Visible Technologies LLC for the purpose of delivering the text messages you have consented to receive and for related program administration.

7. Third-Party Intellectual Property Complaints

If you are a third party (including but not limited to a venue owner, trademark holder, or rights holder) and believe that Content on our platform infringes your intellectual property or misuses your name, trademark, or likeness, please refer to Section 8 of our Terms of Use for our formal complaint and takedown procedure.

Visible Technologies LLC processes all intellectual property complaints in accordance with our Terms of Use and applicable law. Visible is a neutral platform and does not independently verify the authorization status of venues or other third-party information listed by event organizers.
